BAMS ERP – Terms of Service
The terms and operating conditions governing institutional access, role-based licensing, and academic record management for Ayurvedic Medical Colleges.
Welcome to BAMS ERP. These Terms of Service ("Terms") constitute a legally binding agreement between BAMS ERP ("we," "us," "our") and your educational institution, college, or university ("Institution"), together with all authorized administrators, faculty, staff, students, and parent users ("Authorized Users").
By registering for, accessing, or utilizing BAMS ERP, the Institution and its Authorized Users agree to be bound by these Terms. If the Institution does not agree, it must not access or use the platform.
1Acceptance of Terms
By accessing or using the platform, the Institution represents that the individual entering into this agreement has the full legal authority to bind the college or organization. Authorized Users agree to adhere strictly to all user conduct rules, privacy mandates, and institutional policies established by their respective college administrator.
2Description of BAMS ERP
BAMS ERP is an Enterprise Resource Planning and institutional management platform built specifically for colleges offering the Bachelor of Ayurvedic Medicine and Surgery (BAMS) curriculum.
Core Platform Capabilities (where enabled):
3License and Platform Usage
BAMS ERP grants the Institution a limited, non-exclusive, non-transferable, revocable license to access and use the platform strictly for its internal educational and administrative operations on a software-as-a-service (SaaS) subscription model.
- Users may not reverse engineer, decompile, duplicate, or resell the platform or its software.
- Users may not bypass authentication controls or attempt to access another institution's data.
- Institutional usage is governed by active subscribed user counts, campuses, and enabled modules.
4Institutional Responsibilities
The Institution serves as the primary licensee and controller of all data uploaded to BAMS ERP. The Institution retains sole responsibility for:
Ensuring all student profiles, faculty records, marks, and attendance data are accurate, complete, and legally collected.
Providing proper notices and obtaining all required consents from students, parents, and employees under applicable privacy regulations.
5User Accounts and Security
Authorized Users are responsible for safeguarding login credentials. Sharing of user credentials is strictly prohibited. The Institution must configure appropriate role-based permissions and immediately revoke credentials upon staff departure or student graduation.
6Academic Data and Institutional Decisions
BAMS ERP is an administrative software tool and does not independently adjudicate student eligibility, exam marks, professional-year progression, attendance thresholds, or disciplinary actions. All academic evaluations and regulatory compliance remain the sole responsibility of the college authorities.
7Subscription Fees and Payments
Subscription terms, invoicing schedules, and fee rates are governed by the applicable institutional commercial agreement ([SUBSCRIPTION TERMS TO BE CONFIRMED]). Non-payment may lead to suspension of access following written notice.
8Service Availability and Maintenance
We make commercially reasonable efforts to maintain platform availability. Scheduled maintenance will be communicated to institutional administrators in advance when possible. BAMS ERP is not liable for disruptions resulting from external network outages, third-party infrastructure failures, or force majeure events.
9Intellectual Property
All software code, user interface designs, logos, database schemas, and documentation are the exclusive property of BAMS ERP and its licensors. Institutional Data remains under the full ownership and control of the Institution.
10Data Export and Termination
Upon termination of service and settlement of accounts, BAMS ERP facilitates the export of core institutional records in supported standard formats before the tenant environment is permanently de-provisioned according to our data retention schedule.
11Limitation of Liability
To the maximum extent permitted by applicable law, BAMS ERP shall not be liable for indirect, incidental, special, or consequential damages. The total aggregate liability of BAMS ERP shall not exceed [APPLICABLE LIABILITY CAP TO BE CONFIRMED BY LEGAL COUNSEL].
12Governing Law and Jurisdiction
These Terms are governed by the laws of [GOVERNING LAW: STATE/COUNTRY]. Courts in [JURISDICTION: CITY/STATE/COUNTRY] hold exclusive jurisdiction over disputes arising out of this Agreement.
